On April 20, 2021, the Michigan Secretary of State and the Michigan Independent Citizens Redistricting Commission filed a petition with the Michigan Supreme Court seeking to extend the state constitution’s redistricting deadlines, citing the delayed release of necessary 2020 Census data until September 30, 2021. They asked the Court to adjust the Commission’s deadlines to require it to publicly release proposed congressional and legislative plans within 72 days of receiving census data and to adopt final plans within 45 days thereafter. The National Redistricting Foundation filed an amicus brief in support of the petitioners, arguing that the November 1 deadline to redraw district as directory and must yield to other constitutional imperatives, including public participation in the redistricting process. On July 9, 2021, the Michigan Supreme Court denied the petitioner’s request for relief.
