Rivera v. Schwab

2.14.2022
  • Kansas
  • Closed

The NRF supported Kansas voters and the nonprofit organization Loud Light in challenging the congressional map. Specifically, the lawsuit claimed the map to be a partisan gerrymander that also dilutes the vote of Black and Hispanic voters in and around Kansas City, in violation of a number of provisions in the Kansas Constitution.

While the NRF-supported plaintiffs won at trial, the KS Supreme Court reversed, determining that there were no discernible judicially manageable standards for partisan gerrymandering cases and that the map did not dilute minority voting strength. The Rivera Petitioners sought relief at the U.S. Supreme Court, which declined to grant certiorari.
