Missouri v. U.S. Department of Commerce
On February 27, 2026, individual voters and organizations supported by the National Redistricting Foundation (NRF) filed a motion to intervene as defendants in the case Missouri v. Dept. of Commerce. In this case, the state of Missouri sued the Commerce Department, demanding a redo of the 2020 census and 2021 congressional apportionment, alleging that the Census Bureau wrongfully counted undocumented people and temporary visa holders. Missouri has also demanded that the Census Bureau not count undocumented people and temporary visa holders for the 2030 census. Missouri’s lawsuit not only grossly misreads the text of the U.S. Constitution, but also, in pursuing a mid-decade redo of the 2020 census, would be an unprecedented and unnecessary effort that would result in the weakening of the rights of immigrants, racial minorities, and voters in particular states. The NRF is directing the legal strategy and providing funding to support the filing of the case. The organizations standing up as proposed intervenors alongside individual voters include the National Association for the Advancement of Colored People (NAACP) and its Missouri chapter, the Services, Immigrant Rights, and Education Network (SIREN), and the Massachusetts Immigrant and Refugee Advocacy Coalition (MIRA). The lawsuit is in the U.S. District Court for the Eastern District of Missouri. The NRF-supported Proposed Intervenor-Defendants filed a motion to dismiss, and separately the court ordered the DOJ defendants to respond to the state of Missouri’s complaint by July 6, 2026.
