Plaintiffs challenged Missouri’s mid-decade gerrymander in Cole County Circuit Court, arguing redrawing lines mid-decade violates the state constitution’s requirement to draw new congressional lines when the state receives new census data, under Art. III § 45 of the Missouri constitution.

Plaintiffs supported by the National Redistricting Foundation (NRF) made a similar claim in Healey v. Missouri in addition to other claims. After the Luther trial court ruled against the mid-decade claim, the case was appealed to the Missouri Supreme Court, and the NRF-supported Healey voters filed an amicus brief in Luther support of the plaintiffs. The Missouri Supreme Court heard oral arguments in the case on March 10, 2026, and a ruling is pending.
